Terms of Service

1. Acceptance of Terms

By creating an account or using SecuraHaul (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Description of Service

SecuraHaul is a safety management platform designed for US trucking companies. The Service includes:

  • Driver records management, including CDL, medical, and annual review tracking
  • Fleet management for trucks and trailers, including registration and inspection tracking
  • File uploads attached to drivers, trucks, and trailers (for example CDL copies, registrations, inspections)
  • Accident and incident reporting with photo and document attachments, plus DataQ challenge tracking
  • Insurance claims management
  • Document creation, electronic signing, and bundled document delivery
  • Driver training authoring, assignment, and a separate driver portal where drivers complete assignments and download certificates
  • Reports, PDF/CSV exports, and audit trails
  • Compliance reporting and audit preparation

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to use the Service
  • One person or legal entity may not maintain more than one account
  • You are responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false, misleading, or fraudulent information
  • Upload files containing malware, viruses, illegal content, or content you do not have the right to store or share
  • Upload personal data of individuals (including drivers) without a lawful basis or appropriate notice
  • Use the Service to send unsolicited commercial messages or to phish recipients of signing or training links
  • Attempt to gain unauthorized access to the Service, other accounts, or driver-portal accounts you do not control
  • Interfere with or disrupt the Service or its servers, or attempt to bypass rate limits or security controls
  • Reverse engineer, decompile, or disassemble the Service
  • Resell, sublicense, or redistribute the Service without permission

5. Your Data and Uploads

You retain ownership of all data and files you submit to the Service. By using the Service, you grant us a limited, worldwide license to store, process, transmit, and display your data and files solely to provide the Service to you.

You are responsible for ensuring that the data you enter is accurate and that you have the right to submit it. This includes driver information, fleet records, accident reports, claims data, and any documents or files you create, upload, or attach to a driver, truck, or trailer.

You are responsible for obtaining any consents required from drivers, employees, or other third parties whose information you submit, and for honoring their rights with respect to that information.

5a. Driver Portal Access

The Service lets you create driver-portal accounts and issue credentials so drivers can complete training assignments and access documents you send them. You are responsible for:

  • Issuing credentials only to the intended driver and instructing them to keep credentials confidential
  • Promptly disabling driver-portal access for drivers who leave your company
  • Any activity that occurs under driver-portal accounts you create

5b. AI Features and the AI Agent

The Service offers optional AI-powered features, including the in-app AI Agent and AI-assisted generation of documents and training content, provided with the help of a third-party AI provider (OpenAI).

The AI Agent is disabled by default. By enabling it, you authorize the Service to transmit the content from your account that is needed to fulfill your requests to the AI provider in order to generate responses and to prepare actions that you confirm. You may disable the AI Agent at any time from your account settings, after which it will no longer access your data. Under the AI provider's API terms, content sent to fulfill your requests is not used to train its models.

You are responsible for ensuring you have any consents or lawful basis required to process, via these AI features, the data of drivers, employees, or other third parties that you submit. The AI Agent requests your confirmation before making changes to your records, and you remain responsible for reviewing and verifying any AI-generated output before relying on it. AI features are subject to the disclaimers in Section 7 (Compliance Disclaimer — No Guarantee of Outcomes).

6. Document Signing

The Service provides electronic signature functionality. By using this feature:

  • You agree that electronic signatures created through the Service are legally binding to the extent permitted by applicable law, including the ESIGN Act and UETA
  • You are responsible for verifying the identity of recipients before sending documents for signing
  • We store signed documents and signature records for audit purposes
  • We do not guarantee that electronic signatures will be accepted by all parties or jurisdictions

7. Compliance Disclaimer — No Guarantee of Outcomes

SecuraHaul is a recordkeeping and workflow tool. It is not a guarantee of any outcome. Specifically:

  • No guarantee of audit passage. Use of the Service, including its DOT Audit Package, Driver Qualification File (DQF), and any other reports, does not guarantee that your company will pass any audit conducted by the Federal Motor Carrier Safety Administration (FMCSA), Department of Transportation (DOT), state agencies, insurance underwriters, or any other party. Audit outcomes depend on factors outside our control, including the underlying accuracy and completeness of the data you provide, the auditor's independent judgment, and your operational practices.
  • No guarantee of legal outcomes. Use of the Service, including the Lawsuit Defense Packet feature or any document generated by the Service, does not guarantee any particular outcome in any legal proceeding, claim, lawsuit, settlement negotiation, or insurance dispute. The materials produced by the Service are not a substitute for the advice of a licensed attorney, and we make no representation that any output of the Service will be admissible as evidence in any jurisdiction.
  • No legal or regulatory advice. Nothing in the Service or its outputs constitutes legal, regulatory, insurance, medical, or financial advice. You should consult qualified professionals for advice specific to your situation.
  • AI-generated content. Some features (including risk scoring, AI coaching summaries, AI training generation, and AI document generation) use automated systems that may produce inaccurate, incomplete, or outdated information. You are responsible for reviewing and verifying any AI-generated output before relying on it, sharing it externally, or using it in any compliance or legal context.
  • Your responsibility. You are solely responsible for: (a) the accuracy and completeness of all data you enter or upload into the Service; (b) ensuring your company's compliance with all applicable federal, state, and local regulations, including but not limited to FMCSA, DOT, and OSHA requirements; (c) maintaining your own records and backups; and (d) all decisions made based on Service outputs.

By using the Service, you acknowledge that SecuraHaul, its operators, employees, contractors, and affiliates make no warranties, express or implied, regarding compliance outcomes, legal outcomes, audit results, or the accuracy of any information generated by the Service.

8. Subscription and Payment

  • Most features of the Service require a paid subscription. Limited free trials may be offered from time to time.
  • Subscriptions are processed by Lemon Squeezy, which serves as the merchant of record. By subscribing, you also agree to Lemon Squeezy's terms of service.
  • Subscription fees are billed in advance on the cadence shown at checkout (monthly or annual)
  • Subscriptions renew automatically until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
  • All fees are non-refundable unless otherwise stated or required by law
  • We reserve the right to change pricing with 30 days' notice prior to your next renewal
  • Failure to pay may result in suspension or termination of your account. Records may be retained as required by law during any suspension period.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, SecuraHaul and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

11. Indemnification

You agree to indemnify and hold harmless SecuraHaul, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

  • You may terminate your account at any time by contacting us
  • We may suspend or terminate your account for violation of these Terms
  • Upon termination, your right to use the Service ceases immediately
  • We may retain certain data as required by law or regulation

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of the state in which SecuraHaul is incorporated.
