Terms of Service

By creating an account or using SecuraHaul (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.

SecuraHaul is a safety management platform designed for US trucking companies. The Service includes:

• Accident and incident reporting and tracking
• Insurance claims management
• Document creation, signing, and management
• Driver training tracking
• DataQ challenge assistance
• Compliance reporting and audit preparation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• One person or legal entity may not maintain more than one account
• You are responsible for all activity that occurs under your account

You agree not to:

• Use the Service for any unlawful purpose
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to store or transmit malware
• Resell, sublicense, or redistribute the Service without permission

You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited license to store, process, and display your data solely to provide the Service to you.

You are responsible for ensuring that the data you enter is accurate and that you have the right to submit it. This includes driver information, accident reports, and any documents you create or upload.

The Service provides electronic signature functionality. By using this feature:

• You agree that electronic signatures created through the Service are legally binding to the extent permitted by applicable law, including the ESIGN Act and UETA
• You are responsible for verifying the identity of recipients before sending documents for signing
• We store signed documents and signature records for audit purposes
• We do not guarantee that electronic signatures will be accepted by all parties or jurisdictions

While SecuraHaul is designed to help trucking companies with safety management and FMCSA compliance, the Service does not constitute legal or regulatory advice. You are solely responsible for ensuring your company's compliance with all applicable federal, state, and local regulations, including but not limited to FMCSA, DOT, and OSHA requirements.

• Some features of the Service may require a paid subscription
• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• We reserve the right to change pricing with 30 days' notice
• Failure to pay may result in suspension or termination of your account

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service interruptions.

To the maximum extent permitted by law, SecuraHaul and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

You agree to indemnify and hold harmless SecuraHaul, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

• You may terminate your account at any time by contacting us
• We may suspend or terminate your account for violation of these Terms
• Upon termination, your right to use the Service ceases immediately
• We may retain certain data as required by law or regulation

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of the state in which SecuraHaul is incorporated.
